One of the most common questions I get: "How long will this stay on my credit?" The answer depends on the type of negative item. Here's the full timeline, straight from the Fair Credit Reporting Act (FCRA).
| Negative item | Time on your report |
|---|---|
| Late payments (30+ days) | 7 years |
| Collections (paid or unpaid) | 7 years |
| Charge-offs | 7 years |
| Foreclosure | 7 years |
| Repossession | 7 years |
| Chapter 7 bankruptcy | 10 years |
| Chapter 13 bankruptcy | 7 years |
| Hard inquiries | 2 years (affects score for 1) |
| Civil judgments & tax liens | No longer reported (removed 2017) |
The clock starts on the original date
Here's something people often misunderstand: the 7-year clock starts from the date of the original delinquency — the month you first went late — not from when the collection was opened or when you paid it. Paying a collection doesn't restart the clock.
A paid collection and an unpaid collection both fall off at the same time — 7 years from the first missed payment.
But the impact fades long before it falls off
The good news: the negative item's effect on your score gets weaker as it ages. A late payment from 6 months ago hurts a lot. The same late payment from 5 years ago barely moves the needle. Credit scoring models weight recent behavior much more heavily than old history.
So even if you have a negative mark you can't remove yet, time is on your side. Keep adding positive history and the old stuff matters less and less.
What can be removed early?
Items can be removed before the 7 years are up if they're inaccurate, outdated, or unverifiable. This is where credit repair — done right — comes in. Under the FCRA, you have the right to dispute any item you believe is incorrect. If the creditor can't verify it within 30 days, the bureau must remove it.
This is why factual disputing works: it's not about tricking the system, it's about holding creditors to their legal obligation to prove what they're reporting about you.
What you can do right now
- Pull your free reports at annualcreditreport.com — you're entitled to one from each bureau every week.
- Look for items older than 7 years (10 for Chapter 7) — these should already be gone. Dispute them if they linger.
- Check for accuracy on every negative item — wrong dates, wrong balances, accounts that aren't yours.
- Don't close old positive accounts — the good history is helping you.
- Add new positive history — an on-time payment today starts diluting the negatives immediately.
